T&Cs Information

You may be aware that the non-clinical elements of NHS PASA merged with Buying Solutions in October 2009. This involved the transfer of framework agreements and staff to Buying Solutions. The Department of Health (DH) has taken on responsibility for the NHS Standard terms and conditions (T&Cs), which can be found on their web site. Buying Solutions’ T&Cs are broadly similar to the PASA terms and provide the same level of protection.

John Warrington of PICD (DH) says:

 “The NHS is in safe hands with Buying Solutions. They are a reputable professional buying organisation for the public sector. The Terms and Conditions they use in their procurements are very similar to those of PASA and applicable for health customers. NHS users need not be concerned.

In addition, I am currently reviewing the standard sets of T&Cs that can be used by the NHS when conducting a local procurement of their own (ie for areas not covered by the national arrangements in place with Buying Solutions).”  

Please note that, when using framework agreements, you should use the call-off T&Cs of that agreement. You may use special terms, which are specific to your requirement or alternative/additional terms defined in the framework. However, you should not replace the  T&Cs with another set as this would not comply with EU Regulations.
